Terms of Service

1. Agreement to Terms
By accessing or using the Climax AI platform ("Service") at climax-agents.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms apply to all users, including business clients and their representatives.
2. Description of Service
Climax AI provides an AI-powered virtual receptionist platform that allows businesses to deploy voice AI agents to handle inbound phone calls. The Service includes call answering, transcript generation, call summarisation, appointment request detection, email notifications, and a client-facing dashboard for reviewing call activity.
3. Account Registration
To use the Service, clients must be invited by a Climax AI administrator and create an account using a valid email address. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at climaxagents@gmail.com if you suspect any unauthorised access to your account.
4. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws
- Deploy AI agents to deceive callers without appropriate disclosure
- Use the Service to collect data from callers without their knowledge
- Attempt to reverse engineer, hack, or interfere with the platform
- Resell or sublicense access to the Service without written permission from Climax AI
- Use the Service in industries that handle regulated health information (HIPAA) without a signed Business Associate Agreement
5. Call Recording and AI Disclosure
All calls handled by Climax AI agents are recorded and transcribed. Our AI agents disclose to callers at the start of each call that they are speaking with an AI and that the call may be recorded. Clients are responsible for ensuring their use of the Service complies with all applicable call recording and AI disclosure laws in their jurisdiction, including but not limited to two-party consent states in the United States.
6. Client Responsibilities
Clients are solely responsible for:
- The accuracy of business information provided to configure their AI agent
- Ensuring their use of the Service complies with applicable laws in their jurisdiction
- How the call data and summaries are used and shared within their organisation
- Notifying their customers that calls are handled by an AI system
7. Intellectual Property
The Climax AI platform, including its software, design, and content, is owned by Climax AI and is protected by applicable intellectual property laws. Call transcripts and summaries generated from your calls are your data — we do not claim ownership over them. You grant us a limited licence to process and store that data solely to deliver the Service.
8. Service Availability
We aim to provide reliable uptime but do not guarantee uninterrupted access to the Service. The Service may be affected by the availability of third-party providers (Vapi, Supabase, Resend, Vercel). We are not liable for service interruptions caused by these providers or by factors outside our reasonable control.
9. Limitation of Liability
To the fullest extent permitted by law, Climax AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to missed calls, inaccurate transcripts, or AI responses that do not meet your expectations. Our total liability to you for any claim arising out of these Terms shall not exceed the amount you paid us in the 3 months preceding the claim.
10. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind, either express or implied. We do not warrant that the AI agents will be error-free, that transcripts will be perfectly accurate, or that the Service will meet any specific business requirements.
11. Termination
Either party may terminate the service relationship at any time by providing written notice to climaxagents@gmail.com. Upon termination, your access to the platform will be revoked. Call data and logs will be retained for up to 90 days after termination before permanent deletion, unless you request earlier deletion.
12. Changes to Terms
We may update these Terms from time to time. We will notify active clients of material changes via email. Continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
13. Governing Law
These Terms are governed by and construed in accordance with applicable law. Any disputes arising from these Terms shall be resolved through good-faith negotiation, and if unresolved, through binding arbitration or the courts of competent jurisdiction.
